How is UAE gratuity (EOSB) calculated?
Under the 2022 UAE Labour Law: 21 working days of basic salary per year for the first 5 years, then 30 calendar days of basic salary per year for each year beyond 5. The total is capped at 2 years of gross salary.
Do I get gratuity if I resign in UAE?
Yes. Under the 2022 UAE Labour Law (effective February 2022), the resignation penalty has been removed. You receive the same EOSB whether you resign or are terminated, as long as you have completed at least 1 year of service.
What salary is used for UAE gratuity calculation?
Only your basic salary is used. Housing allowance, transport allowance, and other benefits are excluded from the EOSB base under UAE Labour Law.
Is there a maximum cap on UAE gratuity?
Yes. The total EOSB cannot exceed 2 years of your gross (total) salary, regardless of how many years you have worked.
Can I get UAE gratuity if I worked less than 1 year?
No. A minimum of 1 year of continuous service is required to be eligible for EOSB under UAE Labour Law.
Is UAE gratuity taxable in India?

What is the difference between limited and unlimited contracts for gratuity?
Under the 2022 UAE Labour Law, both limited (fixed-term) and unlimited contracts follow the same gratuity formula. The old penalty system for limited contract resignation was abolished.
How soon must my employer pay my EOSB?
UAE Labour Law requires the employer to settle all dues including gratuity within 14 days of the last working day.
